Greene Espel client wins dismissal of patent infringement claims
10/02/2009

On Friday, October 2, 2009, Judge Montgomery of the United States District Court for the District of Minnesota granted Greene Espel’s motion to dismiss a patent infringement lawsuit brought against firm client J&S Fabrication, Inc., based in Pennsylvania. Ductcap Products, Inc. sued J&S in May 2009 for alleged infringement of a patent and sought damages, injunctive relief, attorneys’ fees, and other relief. While J&S was ready to demonstrate the patent’s invalidity and to prove that J&S did not infringe, it took the threshold step of pointing out to the court its lack of jurisdiction over J&S. Ductcap opposed the motion, but the court ruled in J&S’s favor. Bob Gilbertson and Monte Mills handled the case for J&S.
