Greene Espel clients win summary judgment in takings case

On January 12, 2010, Hennepin County Judge Denise Reilly granted summary judgment motions Greene Espel had filed on behalf of the City of Bloomington and the Metropolitan Airports Commission. The suit sought over $5 million in compensation due to an alleged “taking” of the Plaintiffs’ property.


The Plaintiffs own or operate a business in Bloomington that is located south of the end of a new runway at Minneapolis-St. Paul International Airport. They alleged that the operation of that runway, and the City’s additional zoning restrictions (adopted in anticipation of the new runway), harmed the use and value of their property to such an extent that the court should require the City and the Commission to acquire their property.Judge Reilly granted summary judgment on Plaintiffs’ remaining claims, having previously dismissed three of the Plaintiffs’ five claims.
