Greene Espel client wins summary judgment in excessive force suit

On December 12, 2013, the United States District Court for the District of Minnesota granted summary judgment to Greene Espel’s client, an Olmsted County sheriff’s deputy. The lawsuit involved the deputy’s use of a police dog to find and detain the plaintiff, who had hidden in a wooded area after the burglary of a nearby home. The court found that the deputy’s decision to use the police dog and the manner in which the dog was used was reasonable, and that the injuries involved were de minimis.
